ATTORNEY GETS PRISON FOR MISAPPLYING CLIENT'S MONEY

 

 

San Antonio, Texas: December 8, 2009:

Bexar County District Attorney Susan D. Reed announced today that Orin Wayne Crocker, 62, and a formerly licensed attorney in the State of Texas, was sentenced to 5 years in prison and ordered to pay $50,000 in restitution by 290th District Judge Sharon MacRae for the felony criminal offense of Fiduciary Misapplication.

The State alleged that Mr. Crocker engaged in criminal conduct by accepting funds from an insurance settlement and failing to transfer those funds to his client who had sustained fire damage to her house. The State alleged Mr. Crocker misapplied for his own use and benefit $50,000.00 in insurance proceeds that were rightfully due and owing to his client.

Fiduciary Misapplication $20,000 to $100,000 is a third degree felony offense which carries a punishment range of two to ten years in prison and a fine up to $10,000. As part of the plea agreement, Crocker was required to surrender license to practice law in the State of Texas.
