Maximum Sentences Given in First Case of Super Aggravated Sexual Assault of a Child

 

 

San Antonio, Texas: October 7, 2010

Today a Bexar County jury returned the maximum sentences of Life in prison for two counts of “Super” Aggravated Sexual Assault of a Child, the first trial of its kind in Bexar County. Additionally, Defendant was sentenced to an additional Life term for Continuous Sexual Abuse of Young Children. The Defendant was also found guilty of two counts of Indecency with a Child for which he received the maximum 20 years in prison for each count. Upon accepting the jury’s punishment verdict, 227th District Court Judge Phillip Kazen immediately ordered that the sentences be “stacked” meaning that each sentence must be served consecutively rather than concurrently. The three Life sentences are served without possibility of parole.

Defendant Adam Delgado, age 32, was found guilty of continuously sexually abusing two girls, ages 7 and 11, both relatives, between June and November 2008. The sexual assaults consisted of oral, vaginal, and anal penetration of the children. At the time of the sexual abuse, the Defendant knew that he was HIV positive. The Jury found the Defendant used his bodily fluids as a deadly weapon during the sexual assaults. To date, neither child victim has tested positive for the deadly virus, which causes AIDS.
